Except in limited circumstances, parties who wish to file applications in the Family Court of Western Australia for children’s matters and/or property settlement need to comply with strict requirements to participate in a form of mediation in an attempt to resolve matters prior to resorting to Family Court litigation. This can include mediation with just the parties and a mediator, or a mediation style conference, involving the parties, their respective solicitors and a qualified mediator.
Parties who reach an agreement during mediation can have their agreements made into a Family Court Consent Order or, in some cases a Binding Financial Agreement, Child Support Agreement and/or Parenting Plan.
Our Legal Practitioner Director, Meredith Hunter, is a Nationally Accredited Mediator and a Family Dispute Resolution Practitioner (“FDRP”) and is therefore qualified to conduct Mediations and Mediation Style Conferences in Family Court matters for both child issues and property settlement matters. As a FDRP Meredith is qualified to issue a 60I certificate in the event that a party refuses to participate in mediation or an agreement is not reached on child matters. A 60I certificate will allow parties to file an application for child issues in the Family Court.
Meredith has also co-mediated in human resources matters and has coached and adjudicated mediation students.
